Securing a Fair Settlement
You’ll need to come to an agreement with your ex-partner about how to equitably divide your property, possessions and responsibilities. In some cases, you may be able to do this on your own. However, it’s often best to protect yourself by having our family lawyers draw up a Consent Order. This outlines your plan and can help to keep things fair.
If you’d prefer to apply for a court-ordered settlement, we will work in the best interests of you and your children to help you reach your desired outcome. This settlement may be in regard to your property, maintenance or child support. To find out more, please book an appointment with our lawyers.
At O’Reilly & Sochacki Lawyers, we have a special interest in family law and helping families through the turbulent process of relationship breakdowns.
Frequently Asked Questions
What happens if we can’t agree on a parenting arrangement?
If parents can’t agree on a parenting arrangement, they may need to attend family dispute resolution before applying to the court. If agreement is still not reached, the court will make parenting orders based on the child’s best interests. This includes factors like safety, emotional wellbeing, and maintaining meaningful relationships with each parent. Decisions can cover where the child lives, time spent with each parent, and other responsibilities like schooling and healthcare.
Is superannuation included in a property settlement?
Yes, superannuation is treated as property under the Family Law Act and can be divided between separating couples through a process called superannuation splitting. This doesn’t mean immediate access to funds—it simply adjusts each party’s entitlements within their super accounts. It’s separate from cash or real estate and requires its own valuation and agreement or court order.
Can a de facto partner make a claim after separation?
A de facto partner can make a property or financial claim after separation if certain legal criteria are met. These usually include living together for at least two years, having a child together, or having made significant financial or non-financial contributions. Claims must generally be made within two years of the relationship ending. The same principles used in married couples’ property settlements often apply.
